Delhi, March 12: On Tuesday, the Supreme Court raised questions to six dissenting Congress MLAs from Himachal Pradesh, inquiring why they had not sought the high court’s intervention to contest their disqualification. These legislators were ousted from the Himachal Pradesh Assembly by the Speaker for defying the party’s directive and supporting the opposition’s nominee in the recent Rajya Sabha elections.

During the hearing, led by Justices Sanjiv Khanna, Dipankar Datta, and Prashant Kumar Mishra, the MLAs’ legal representative sought a postponement due to the absence of their lead counsel. Nevertheless, the bench expressed curiosity about their decision to bypass the high court and remarked on the non-fundamental nature of being elected as MLAs. The case is scheduled for further hearing on March 18.

The six disenfranchised MLAs—Rajinder Rana, Sudhir Sharma, Inder Dutt Lakhanpal, Devinder Kumar Bhutoo, Ravi Thakur, and Chetanya Sharma—have approached the apex court challenging the Speaker’s ruling, alleging a breach of the ‘natural justice’ principle in their plea. After siding with the BJP candidate in the Rajya Sabha elections, these rebels refrained from participating in the subsequent budget vote.
