Delhi, 2 February (H.S): The Supreme Court on Friday declined to take up a Public Interest Litigation (PIL) that sought to have a new election symbol of handcuff for candidates with criminal backgrounds.
The bench, led by Chief Justice D Y Chandrachud, stated that it was not within their authority to make changes to electoral policies. They further explained that such decisions are left to the discretion of the government and cannot be imposed by the court. Justices J B Pardiwala and Manoj Misra were also part of the bench that rejected the PIL.
The counsel representing the petitioner was urged by the bench to withdraw the case, which was eventually dismissed as withdrawn. The PIL was filed by Sudheer, and it sought to have a separate election symbol for candidates with criminal histories in order to create more awareness among voters.
However, with the Supreme Court’s decision, this matter will not be pursued any further. This incident highlights the judiciary’s commitment towards upholding constitutional principles and respecting the separation of powers between different branches of government.
